SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between Investment Property Services (“Manager” or “Landlord”) and “Guest” as listed, signed and dated digitally through the placement of the reservation online For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned owner, manager or agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
Property. The property is located at the address provided at the completion of the reservation. The property is fully furnished and includes the items listed on the enclosed inventory sheet, Exhibit A. Guest assumes full responsibility for any items found to be missing and any damage due to misuse, negligence or action on Guest's or Guest’s visitors part, except in the case of normal wear-and tear and missing items reported to Manager within 48 hours of Check-in.
Rental Party: The rental party shall consist of Registered Guest and the additional Guests accompanying the named reserved party.
Guest agrees that no more than 8 persons in Unit A or 4 persons in Unit B persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.
Use and occupancy of the Property is limited to the Registered Guest and the additional Guests accompanying the named reserved party.
The registered Guest and party (ies) on this Agreement are the only overnight guests allowed, unless prior written permission is received from Manager.
The Guest accepting this Agreement will be held responsible for all other parties and/or guests of the Guest for compliance with this Agreement, with listed policies, ordinances, rules and regulations and for any losses incurred by Manager or to the Property due to negligence or vandalism.
Term of the Rental Agreement. The property rental period begins and ends at the date and time specified in the reservation made online.
Short-Term Rental: It is expressly understood and agreed that this is a short-term vacation rental (For US, under the provisions of Chapter 509, Florida Statutes) and is not a lease or other long term residential tenancy agreement. This Agreement is only for the licensed use of the Property for the stated Term. It creates no property rights in Guest and no rights to renewal or for recurring usage. This Agreement is also neither a Time-Share sale or a Plan of Time-Share Development, nor a Vacation Club.
Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit B at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
Cause for Eviction:The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, noise ordinance, parking or suspected illegal activity. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money.
Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of Reservation Deposit and Final Balance, if paid, and such party will not be permitted to check in and/or will be subject to immediate eviction with the forfeiture of all amounts paid.
Access: Guest shall allow Manager access to the property for purposes of repair and inspection. Manager shall exercise this right of access in a reasonable manner. Emergency repairs (plumbing, electrical or A/C items) will require no advance notice. For routine maintenance and showings, the Manager shall provide 24 hours notice (via posting, email, text message, or phone message) to the Guest. After such notice, Manager may enter premises even if Guest is not present.
Rental Rate and Fees
The rental rate and fees for the rental term is that specified in the online reservation. There is no security deposit in this contract.
Utilities: Included in the rent are water, electricity, basic cable and Wi-Fi. Manager is not responsible for outages in Wi-Fi or internet provided by Comcast and shall not be responsible for any losses due to temporary service outage. If the guest has an internet sensitive business such as day-trading, guest is advised to obtain additional internet service via mobile hotspot or the like.
Repairs and maintenance: Repair and maintenance problems must be brought to Manager's attention within 48 hours of occupancy or occurrence, or Guest will be held liable for all such damages or repairs. Manager has 10 business days to address maintenance issues raised by Guest without any adjustment or refund of rent. Manager will not be responsible for any unauthorized expenses incurred by Guest or his/her guests.
Plumbing is provided in good, free-flowing condition unless otherwise reported by resident within 24 hours of check-in. Any stoppage in the plumbing occurring during Guest’s stay shall be the responsibility of Guest to repair.
Washer/dryer are provided in good, working condition unless otherwise reported by resident within 24 hours of check-in. Guest shall take care to not overload the washer or dryer. Overloading can cause damage to the units including broken belts, Any damage to the units causing malfunction, including broken belts, shall be the responsibility of the Guest to repair. No refunds or modification of the rental rate shall be made in the event of malfunction of the washer or dryer.
Cancellation policies are those set forth in the terms of the reservation referenced above.
If no cancellation policy is specified online, the following terms shall apply:
For a 50% refund, cancellation must be made 30 full days prior to listing’s local check in time (or 3:00 PM if not specified) on the day of check in.
If the guest cancels less than 30 days in advance, the nights not spent are not refunded.
If guest arrives and decides to leave early, the nights not spent are not refunded.
Storms: No refunds will be given for storms or other natural disasters. It is highly recommended that Guest obtain traveler’s insurance to address such risks.
Indemnification and Hold Harmless:
Guest(s) will reimburse Landlord and its property manager, and their respective owners, officers, directors, shareholders, affiliates, agents, employees, and representatives (collectively, “Landlord Parties”) for and will indemnify, defend, and hold harmless Landlord Parties from and against any and all loss, damage, liabilities, theft, cost, expense or penalty sustained by, liability or charges imposed on, and claims or causes of action asserted against, Landlord Parties arising in whole or in part out of or by reason of
any accident or occurrence in or on the Premises, any use of or business conducted in or on the Premises, or any hidden or apparent defect in the Premises; or
any damage to or loss of any property of Guest(s) or any person occupying the Premises (collectively, “Guest(s) Parties”), whether this damage to or loss of property occurs on the Premises or on any other part of the Property; or
any act, negligence, or fault of Guest(s) Parties, whether occurring on the Premises or on any other part of the property.
Guest(s) reimbursement and indemnity obligations will include, but not be limited to, any and all penalties, assessments, fines, damages, interest, settlement amounts, judgments, losses, reasonable attorneys’ fees, and other expenses, and will survive the expiration or other termination of this Agreement.
Guest is encouraged to secure the appropriate travelers or vacation insurance and/or renter’s insurance.
No insurance of the guests contents is provided or implied in this (website hidden)’s Fees and Costs: If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Manager for reasonable attorney's fees and costs incurred by Manager.
This Agreement is made in, and shall be governed solely by the laws of, the State of Florida and Chapter 509, Florida Statutes. Venue for enforcement shall be Broward County, Florida . If any section, clause, paragraph or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Agreement is taken in full compliance with federal, state and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap or familial status.
The Guest hereby waives all rights to a jury trial and agrees to resolve any issues via Mediation first, and if unsuccessful, then via Binding Arbitration.
The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the acceptance and payment of the online reservation.

People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Managers are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
Keep the property and all furnishings in good order

PETS are permitted only with prior approval and the Pet Addendum must be completed.
Parking is limited to 1 vehicle(s). Vehicles are to be parked in designated parking area labeled “A” on the south side of the building only. Parking on the road or grass is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units. We provide initial supplies (toilet paper, paper towels, dish soap, hand soap, dishwasher detergent and garbage bags) but replenishment is the responsibility of the Guest during their stay.
A/C should not be set less than 76°F in summer or Heater set above 70°F in winter. $50 of electricity per week is the allowance per contract.
It is the responsibility of the Guest to leave the Property in reasonably clean condition and to remove all Guest's property (and trash) upon Departure. During stay, Guest agrees to bag garbage and place the bags into the city garbage container. Only the garbage container will be picked up. Any garbage not in the container will not be picked-up. If the garbage container is overfull it will not be picked-up. Garbage collection days are Monday & Thursday morning 7AM. It is advised to put out the garbage the day or night before pick-up as they usually come very early in the morning.
*** Prior to Departure, Guest shall clean all dishes (or run the dishwasher prior to leaving) to avoid the attraction of pests.***
Pest control service is performed by the owner periodically between tenants. Any occasional pests found during the rental period shall be addressed by the Guest.
PET LIABILITY WAIVER AND PET RESPONSIBILITIES
Guest(s) agree(s) as follows:
To keep the pet from causing any annoyance or discomfort to others and to immediately remedy any complaints concerning the pet; To ensure shall not create any conflict or disturbance with others and will not threaten any physical harm to anyone;
To comply with all applicable statues, ordinances, restrictions, and other enforceable regulations regarding any pet;
To keep the rabies shots of any pet current;
To keep the pet under control at all times; To confine any pet that is a dog or cat, when outside, by fences or on leashes under Guest(s)’s control and to confine any pet other than a dog or cat in appropriate cages at all times;
To promptly remove any pet waste from the Property, including all living areas, garages, storage areas, yards, porches, patios, courtyards, decks;
To keep the pet from damaging any property belonging to the Landlord or others and to immediately pay for any injury, damage, loss, or expense caused by the pet. Any damage to the exterior or interior of the premises, grounds, flooring, walls, trim, tiles, carpeting, or any stains, caused by the pet will be the full financial responsibility of the Guest(s) and that Guest(s) agrees to pay all costs involved in the restoration to its original condition. If because of any such stains, etc., said damage is such that it cannot be removed, then Guest(s) hereby agrees to pay the full expense of replacement. The Guest(s) hereby agree to accept all liability, costs and risks associated with their pet(s) for any incidents that occur at the property.
To hold the Landlord harmless from all liability arising from the Guest(s)’s ownership or keeping of the pet, including but not limited to any liability resulting from the Landlord turning said pet over to local pet policing authorities should the pet be found unsupervised;
To control flea infestation and will exterminate if necessary, and upon demand, in any and all areas affected with full cost to be paid by Guest;
In addition to Owner’s rights under the Rental Agreement, if Owner receives any complaint regarding the Pet or otherwise has reason to believe that a violation regarding the Pet has occurred, Owner and/or Agent may enter the Premises to investigate the possible violation.
By accepting and paying for this online reservation, the Guest (s) agrees to accept full responsibility for any pet injury(s) and associated lawsuit(s) and agrees to be personally responsible for paying any such claims, which may include medical expenses, wage loss, scarring and pain, and suffering damages of the injured person(s). If the injured person(s) sues the Landlord or the Guest(s) then the Guest (s) agrees to be responsible for hiring and paying for all claims and attorneys’ fees and defending themselves and the landlord against any lawsuits/claims.
