1. The reservation is accepted based on the amount of guests that was mentioned on the requests, and therefore only these guests are allowed to stay in the apartment together with the person who made the reservation. 2. SECURITY DEPOSIT/DAMAGE CLAIM. There will be no charge if ALL of the following rules observed: a)No damage is done to the PROPERTY or its contents, beyond normal wear and tear; b)All debris, rubbish and discards are placed in trash; c)All soiled dishes are washed and put away (including dishes in dishwasher); d)All keys are left and PROPERTY is securely locked; e)No linens, towels are lost or damaged; f)No smoking in the PROPERTY; g)PETS are NOT allowed in the PROPERTY. A fine of $500.00 will be charged if this rule is violated; h)DO NOT FLUSH anything other than toilet paper. No feminine products or other things should be flushed at anytime. If it is found that anything other than the toilet paper has been flushed and clogged the septic system, there will be charge for all the damages caused by such actions. i)All appliances shall be only used according to their normal intended use. j) All the house rules are observed. 3. GUEST accepts the above terms and agrees to be held responsible for all breakage or other damage or loss to the PROPERTY that may result from occupancy of the PROPERTY except normal wear. 4. GUEST shall take good care of the PROPERTY including appliances, equipment and furnishings. GUEST takes full responsibility for all conditions caused by negligent or wrongful act or omission of the GUEST and/or person(s) accompanying GUEST. 5. If GUEST defaults in the performance of any of the obligations contained herein, OWNER shall be entitled to recover all costs and expenses as well as court costs and reasonable attorney's fees. 6. At the end of the term, GUEST is responsible for leaving prior to or at 11:00 AM check-out time. All dishes should be placed in the kitchen sink, all trash in the trashcans. GUEST will be responsible for excessive cleaning charges at the OWNER'S discretion. 7. Upon execution of this Lease, OWNER shall provide GUEST with a set of keys to facilitate access to the PROPERTY. GUEST shall reimburse OWNER full cost of repair or replacement if any or all keys are subject to negligent malfunctioning, loss or theft. Guest agrees to pay $50.00 unless all such keys are returned upon departure of PROPERTY. 8. Utilities are included unless otherwise noted. Internet service is provided with wireless connection. 9. GUEST shall not keep or have on the leased PROPERTY any article or thing of a dangerous, inflammable, or explosive character that might unreasonable increase the danger of fire on the leased PROPERTY or that might be considered hazardous or extra hazardous by any insurance company. 10. RIGHT OF ACCESSS: OWNER may enter the premises upon a 24 hour written notice to GUEST. OWNER may enter at any time in cases of emergency, without notice. 11. ANIMALS: GUEST shall keep NO domestic or other animals on/or about the leased PROPERTY. 12. SURRENDER OF PROPERTY: At the expiration of the Lease term, ALL GUESTS shall quit and surrender the premises hereby demised in as good state and condition as they were at the commencement of this Lease, reasonable use wear thereof accepted. 13. PERSONAL AND PROPERTY LOSS AND LIABILITY: OWNER is NOT liable for damage, theft, vandalism, or other loss of any kind to GUEST's personal property and/or GUEST's occupants, invites or guests. OWNER shall not be responsible or liable for any injury, loss or damage to any person or property of GUEST or any other person in or on the PROPERTY that is not a result of intentional conduct or gross negligence by the OWNER. 14. CLEANLINESS AND TRASH: The PROPERTY must be kept clean and sanitary. NO littering of papers, cigarettes butts, or trash is allowed. 15. INDEMNIFICATION: GUEST shall indemnify and hold Landlord harmless from and against any and all penalties, claims, demands and liability of any kind or nature, including, but not limited to attorneys' fees and paralegals' fees, all as may be made or sought against OWNER, or the premises arising out of or in any way connected with Guest's repairs, occupancy, use, this lease agreement, personal property, personal injury, maintenance or operation of the premises: and Guest shall defend OWNER from and against each and every such claim resulting in a law suit as a consequence of Guest's actions or inactions. 16. GOVERNING LAW: The law of the New York State shall govern, construe and enforce all of the rights and duties of the parties arising from or relating in any way to the subject matter of this contract. 17. ENTIRE AGREEMENT: This agreement constitutes the entire agreement between OWNER and GUEST. No changes or additions to this Lease shall be made except by written agreement between OWNER and GUEST. 18. CHILDREN. Please note that this apartment is not child proof or child protected as such. 19. Tenant agrees that all expenses associated with Tenant's negligence and default will be deducted from his/her security deposit. 20. The Apartment must be used for vacation purposes only, no commercial use.

Inna (the broker) was very helpful, always available to speak. The apartment was beautiful and everything was spotless. I would highly recommend this to anyone who wants to have a pleasant stay in a beautiful apartment on the upper west side.
