Our property is primarily oriented towards couples and families interested in a peaceful and relaxing vacation. Many of our guests come back year after year, some for only a week and some for 3 months and we are committed to ensuring the standards they have come to expect by strict enforcement of our Rules And Regulations. For this reason, we understand that our property may not be suitable for everyone.
RULES & RESTRICTIONS:
NOISE DISTURBANCES AND PARTIES ARE NOT ALLOWED. SMOKING IS NOT PERMITTED INSIDE THE CONDO. SMOKING IN COMMON AREAS AND TERRACES IS PERMITTED BUT BE SURE TO USE AN ASHTRAY. NEVER DISPOSE OF ASHES OR CIGARETTE BUTTS ONTO A PROPERTY BELOW YOU.
Our Properties are intended to be used solely by the guests indicated in the reservation agreement. Non registered guests are not allowed in the Properties or the common areas of the property including the swimming pool. Any discourteous behavior or noise which may affect the privacy, relaxation and enjoyment of neighboring guests will be considered as grounds for immediate eviction and forfeiture of all rental fees and deposits.
REGISTERING GUEST - Confirms that she/he is at least 25 years of age. Landlord has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period or upon eviction by the Landlord. The Tenants shall vacate the premises at the expiration time and date of this agreement. As a condition of this agreement, the Registering Guest is required to provide the names and ages of all Guests staying in the property.
MAXIMUM OCCUPANCY - The maximum number of guests is limited to five (5) persons in a 2 bedroom unit and seven (7) persons in a 3 bedroom unit. The Tenants shall have no more persons reside or sleep on the premises than indicated above.
USE AND MAINTENANCE OF PROPERTY - The Tenants shall maintain the premises in a good, clean condition, and use the premises only in a careful and lawful manner. The tenants shall leave the premises in a clean condition at the expiration of the rental agreement.
TRASH REMOVAL - The Tenants shall dispose of all waste material generated during the rental period and put the trash in the grey bins located in the parking area during their stay. All trash and perishables must be disposed of and dishes washed before departure. Aluminum cans can be placed in recycle bins provided.
DAMAGE - The Tenants shall pay for any damage done to the premises over and above normal wear and tear.
ANIMALS - No animals or pets of any kind will be brought onto the premises.
SUBLETTING - The Tenants may not sublet the property.
TENANT - The Tenants shall behave in a civilized, polite manner and shall be good neighbors respecting the rights of the surrounding property owners and guests. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners or guests. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hours are from 10 PM to 8 AM. Outdoor noise should be kept to a minimum during those hours. The swimming pool is closed between 10 PM and 8 AM daily.
SMOKING - There shall be no smoking inside the premises. Smoking is permitted outside the home. NEVER DISPOSE OF ASHES OR CIGARETTE BUTTS ONTO A PROPERTY BELOW YOU.
INCLUSIVE FEES - Rates include a one-time linen & towel setup. An initial supply of 2 rolls of toilet paper per bathroom, 2 bars of soap per bathroom, 1 roll of paper towels in the kitchen, dish soap and kitchen sponge are also included in the rental rate. All additional supplies are the responsibility of the guest. A washer and dryer is included in the unit for your convenience. One 5 gallon water bottle will be provided upon your arrival for drinking purposes. Additional bottles are available as needed through the security personnel or gardeners at a very nominal fee. DO NOT USE TAP WATER FOR DRINKING PURPOSES.
AIR CONDITIONING - Tenant agrees that Air conditioning shall not be set below 76 degrees and that the fan setting shall be “Auto”. Doors and windows must be closed when air conditioning is in operation.
GAS OVENS – The kitchen is a non-vented propane gas oven in units so equipped. It must be lighted manually each time you use it. If you are uncertain how to light it or use it properly, please ask for assistance.
PARKING – Parking is limited to one (1) vehicle onsite. Vehicles are to be parked in designated parking areas only or off premise.
SAFETY - It is the Tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool. Tenant agrees to have a responsible adult supervising minors while they swim in the pool. Tenant is hereby notified that the pool can be dangerous and tenant accepts fully the risks involved. Glass containers are not allowed anywhere in the pool area. Jumping and diving into the pool is expressly prohibited. Observe posted pool rules at all times.
TV SERVICE - Satellite TV is provided and the service level has been chosen by the Owner. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service.
INTERNET - High speed, fiber optic wireless internet is provided as a free convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
POWER OUTAGES - We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages.
WEATHER, STORM OR HURRICANE POLICY – No refunds will be given unless:
• The state of Quintana Roo or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or
• A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.
• From the day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund within 21 days:
• Any unused portion of rent from a guest currently registered
• Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted
• Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
RENTAL RESTRICTIONS – No property will be rented or registered to any party under the age of 25 years old. Guests below the age of 25 are allowed but will be the responsibility of the registered guest. Loud, offensive or other behavior which directly interferes with the rights of other owners or guests will not be allowed. If such behavior results in the eviction of any guests all payments including damage deposits will be forfeited.
Non registered guests are not allowed in the condo or any common area at any time without advance permission from Manager. The registered guest to whom the property is rented will be responsible for actions of all registered and invited registered guests within their party.
The common and mutual rights of all guests and owners will be respected at all times. Failure to comply with administration or security personnel requests or instructions may result in eviction.
Pool rules as posted must be observed at all times. No glass is allowed in or around the pool. Jumping and diving is expressly prohibited and both children and adults should refrain from being excessively loud. Music which may disrupt others is not permitted at the pool.
INDEMNITY - All of the units are privately owned; neither the owners nor their representatives are responsible for any accidents, injuries or illnesses that occur while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
TENANCY - Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, prostitution etc., shall cause termination of this agreement with no refund of rents or deposits and immediate eviction.
INDEMNITY & LIABILITY
The Guest is responsible for their own travel/health insurance. Neither the Owner or Manager shall be held responsible in any way for accidental injury, death or damage/loss to personal effects of the Guest. If, due to circumstances beyond the Owner's control, such as flood, fire, hurricane or other damage, the Owner is unable to honor this agreement, the Damage Deposit and advanced payments shall be fully refunded provided said damage was not the fault of the Guest. The Guest is responsible for all damages excluding wear and tear, and including those which exceed the deposit amount.
