2853 NW Mast Ave Terms and Conditions of use:
This Rental Agreement and Contract (the “Agreement”) is a legally binding
agreement made and entered into as of the Reservation Date written below by
and between the undersigned person(s) or company (the “Guest”) and the
undersigned owner, manager or agent (“Rental Agent”), pursuant to which the
Guest has agreed to rent the residence described below (the “Property”), for the
duration of the Rental Term for the Total Rental Fee and other good and valuable
consideration as described herein.
OCCUPANCY
Guest agrees that no more than [Max Guests] persons shall be permitted on the
Property at any time during the Rental Term, all of whom shall comply with the
conditions and restrictions imposed upon Guest under this Agreement.
CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. Rental Agent shall use its best
efforts to ensure the operation of all amenities in the Property, such as internet
access, satellite or cable TV access or hot tubs, fireplaces as applicable. Rental
Agent shall not be held responsible for such items failure to work, but will make
every effort to correct any issues as reported as quickly as possible. Guest
acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces,
decks, and the like may be potentially dangerous and involve potential risks if
improperly used, particularly with regard to children and such use is at the
Guest’s own risk.
Guest shall use the Property for residential purposes only and in a careful
manner to prevent any damage or loss to the Property and keep the Property in
clean and sanitary condition at all times. Guest and any additional permitted
guests shall refrain from loud noise and shall not disturb, annoy, endanger, or
inconvenience neighbors, nor shall Guest use the Property for any immoral,
offensive or unlawful purposes, nor violate any law, association rules or
ordinance, nor commit waste or nuisance on or about the Property.
DEFAULT
If Guest should fail to comply with the conditions and obligations of this
Agreement, Guest shall surrender the Property, remove all Guest’s property and
belongings and leave the Property in good order and free of damage. No refund
of any portion of the Total Rental Fee shall be made and if any legal action is
necessary, the prevailing party shall be entitled to reimbursement from the other
party for all costs incurred.
ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Property or permit the use of any portion
of the Property by other persons who are not family members or guests of the
Guest and included within the number of and as permitted occupants under this
Agreement.
RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, furnishings, personal affects and other
items brought into the Property by Guest or their permitted guests and visitors
shall be at the sole risk of Guest with regard to any theft, damage, destruction or
other loss and Rental Agent shall not be responsible or liable for any reason
whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless Rental
Agent and their agents, owners, successors, employees and contractors from
and against any costs, damages, liabilities, claims, legal fees and other actions
for any damages, costs, attorneys fees incurred by Guest, permitted guests,
visitors or agents, representatives or successors of Guest due to any claims
relating to destruction of property or injury to persons or loss of life sustained by
Guest or family and visitors of Guest in or about the Property and Guest
expressly agrees to save and hold Rental Agent harmless in all such cases.
RELEASE
Guest hereby waives and releases any claims against Rental Agent, the Property
owner and their successors, assigns, employees or representatives, officially or
otherwise, for any injuries or death that may be sustained by Guest on or near or
adjacent to the Property, including any common facilities, activities or amenities.
Guest agrees to use any such facilities or amenities entirely at the Guest’s own
initiative, risk and responsibility.
ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and
with reasonable advance notice for the purposes of inspecting the Property or
showing the Property to prospective purchasers, renters or other authorized
persons. If Rental Agent has a reasonable belief that there is imminent danger to
any person or property, Rental Agent may enter the Property without advance
notice.
UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to
reasons, events or circumstances beyond the control of Rental Agent, Rental
Agent will apply due diligence and good faith efforts to locate a replacement
property that equals or exceeds the Property with respect to occupancy capacity,
location and value that meets the reasonable satisfaction of the Guest. If such
replacement property cannot be found and made available, Rental Agent shall
immediately return all payments made by the Guest, whereupon this Agreement
shall be terminated and Guest and Rental Agent shall have no further obligations
or liabilities in any manner pertaining to this Agreement.
ADDITIONAL TERMS TO THE RENAL AGREEMENT
In addition to the standard terms included herein, Guest acknowledges and
agrees that the following additional terms and conditions apply to the Guest’s
rental of the Property:
GENERAL PROVISIONS
This Agreement contains the entire agreement between the parties with regard to
the rental of the Property, and any changes, amendments or modifications hereof
shall be void unless the same are in writing and signed by both the Guest and
the Rental Agent. This Agreement shall be governed by the laws of the
Commonwealth of The State of Oregon. The words “Rental Agent” and “Guest” shall
include their respective heirs, successors, representatives. The waiver or failure
to enforce any breach or provision of this Agreement shall not be considered a
waver of that or any other provision in any subsequent breach thereof. If any
provision herein is held invalid, the remainder of the Agreement shall not be
affected. Any notice required to be given under this Agreement shall be in writing
and sent to the contact information included herein. This Agreement may be
signed in one or more counterparts, each of which is an original, but taken
together constitute one in the same instrument. Execution of a digital signature
shall be deemed a valid signature.
Bookings canceled at least 30 days before the start of the stay will receive a 100% refund.
Bookings canceled at least 14 days before the start of the stay will receive a 50% refund.
The following are terms and conditions offered with the confirmation of your reservation.
(1) The minimum rental age is 21 or older. Minors should not be in possession of alcohol. Violations
will result in being evicted from the property. No refunds will be issued.
(2) The maximum number of parking space permitted to have up to 6 and 1 boat. All 6 cars must be parked on
the gravel parking lot on the right side of the house. Do not block the neighbors driveway at anytime or use
the neighbors driveway as a turn around. You may use the dead end as a turn around but you may not park at the dead end.
These rules are strictly enforced by the City of Lincoln City. Tickets for parking violations are issued in the amount
of $1,000.00. If a ticket is issued during your stay, you (the renter) will be responsible for paying the
fine. If you have any questions about parking, please contact the owners right away.
(3) Rental Ordinance requires quiet hours in residential neighborhoods between 9:00pm-8:00am,
nor shall Guest use the Property for any immoral,offensive or unlawful purposes, nor violate any law,
association rules orordinance, nor commit waste or nuisance on or about the Property.

If Guest should fail to comply with the conditions and obligations of this
Agreement, Guest shall surrender the Property, remove all Guest’s property and
belongings and leave the Property in good order and free of damage. No refund
of any portion of the Total Rental Fee shall be made and if any legal action is

(4) Please make sure to secure your trash in the provided trash containters. If the container is full,
please contact us immediately. Garbage, glass and recycling protocols are listed on the Lincoln City Sanitary Service Containers.
ALL RECYCLING PLACARDS MUST BE ADHERED TO or you will be charged a $50 cleaning fee.
If you have any questions about garbage and/or recycling, please call us anytime at ). Check-in time is 4:00pm and checkout time is 11:00am. We are happy to accommodate early
check-in and/or a late checkout when possible. You may request an early check-in the day before your
date of arrival and late checkouts may be requested the day before your date of departure by cal) You must not leave any food in the house. Take all of your food items with you upon departure.
(7) For your convenience, you will find a starter supply of toilet paper, paper towels, soaps and
shampoo. All bedding, towels, dishwasher detergent, liquid dish soap and laundry detergent are
provided. We do not replenish supplies during your stay.
(8). The cleaning fee includes routine clean up after your departure. Be certain to move all items from
the washer to the dryer before you leave. DO NOT LEAVE WET LAUNDRY IN THE WASHING MACHINE!
In addition, please wash your dishes, take out the garbage, master bedroom heaters to 60 degrees.
Do not leave more than 2 loads of laundry, as you will be charged an extra $25/hour for this task to be completed.
This means you will have to start doing laundry before you leave until there are only 2 loads left.
Strip all of the beds and remove all of the towels from the bathrooms and bedrooms. If our home is left unreasonably dirty, you will be
charged accordingly for the extra time it takes the housekeeper to clean up afterwards.
(9). We provide comfortable and quality surroundings for our guests so they may fully enjoy their stay.
We ask that you use care with the accommodations so that others may also enjoy them aswell. Please be
responsible for your own actions and your guests while occupying our home. Please do not leave
children under the age of 16 years unattended in our home.
(10). Please respect the property rights of others. Use designated beach access for safety and stay away
from cliffs that might give way under foot or be subject to damage from erosion. Please do not build
fires on the beach unless located in a designated area.
(11). Please observe and adhere to all rules and policies as posted at our home regarding the safe use of
the hot tub, particularly with regard to children and such use is at the Guest’s own risk.
Guest shall use the Property for residential purposes only and in a careful
manner to prevent any damage or loss to the Property and keep the Property in
clean and sanitary condition at all times. Take a cleansing shower before entering the hot tub. If excessive cleaning is required after
your stay, a additional cleaning fee of $50 will be charged. The hot tub and surrounding patio/deck can be
dangerous and can be slippery when wet. You accept and assume all risks involved in or related to the
use of the hot tub and patio/deck areas and release us (the homeowner) from any and all liability or loss
that may result in connection with the use of the hot tub.
(12). NO PETS ARE ALLOWED in our home, including the garage. A non-refundable per pet fee of
$500.00 will be charged if you bring a pet to our home. In addition, you will be asked to vacate
immediately, in respect to all our clients who have allergic reactions to pets.
(13). If maintenance or repairs are required at the home during your stay, please notify us immediately
and allow access to our local property manager to make the necessary repairs. Please notify us
immediately if you are dissatisfied with the condition of our home in any way upon your arrival.
(14). We are not responsible for the recovery cost of lost or stolen personal property. Items not claimed
after 30 days will be donated to Goodwill.
(15) All information contained in our website is deemed reliable but is not guaranteed. We are
constantly upgrading and making improvements to our home. Things may not be exactly in the same
place or condition as when the photos were originally taken.
(16) We reserves the right to charge your credit card for damage, theft, or excessive cleaning as a result
of your tenancy in the unit. Furniture should not be moved in anywhere. You will be billed a fee of $25
per hour to return moved furniture to its proper location.
(17). Occupancy is specifically LIMITED to the MAXIMUM number of 15 people by state law.
(18). Sheets, pillows and blankets for sofa beds can be found in all of the closets throughout the house.
(19). We make no guarantee regarding the hot tub, or appliances. We will make every
reasonable effort to repair during your stay within normal business hours.
(20). Smoking is NEVER allowed in our home or in the hot tub all around our property. Violations will result in a $500.00 fine.
(21). RVs, trailers and campers must be parked off property. 1 boat however is allowed to park on the parking lot.
(22). Please be sure to close and lock ALL windows and doors anytime you leave the home. Prior to
your departure, be sure to close and lock all windows and doors, set the thermostat to AWAY and
close all curtains. Leave the front and back porch lights on.
(23). This Agreement shall be governed by and interpreted in accordance with the laws of the State of
Oregon, and shall be treated as though it were executed in Washington County. Any action relating to
this Agreement shall be instituted and prosecuted only in Washington County, Oregon. Guest
specifically consents to such jurisdiction and to extraterritorial service of process.

This house is the perfect place for a weekend gathering with many family and friends. Everything was just as the listing said and pictured. It is a ten minute walk to the beach and to the store if anything is needed. Plenty of parking. Fun on site with pool table/air hockey and a hot tub. We reserved this place one year before the 2017 eclipse and communication with Paul was great throughout the year. We would stay here again and recommend it highly.
