VACATION RENTAL LEASE AGREEMENT
* The is a non smoking property
This rental agreement (“agreement”) is entered into by and between Benjamin Bycel (“owner”) and __(“renter”). The renter whose name and signature appears on this agreement is authorized to sign for all other renters. This agreement constitutes a contract between owner and renters. If renter signs or has signed any other agreement, for example with Airbnb or (SENSITIVE CONTENTS HIDDEN), and clauses of that other agreement differ or contradict this agreement, the provisions of this agreement shall prevail.
PURPOSE OF AGREEMENT
The purpose of this agreement is to insure that renters enjoy their time at the residence and that all obligations to owner, financial and otherwise, are met
1. Rental Property address(URL HIDDEN)Santa Barbara, CA 93105 (the property)
2. Dates of Rental: The term of the rental begins at 4PM PST on __ 2017 (Check in date) and ends at 11AM PST on ___(check out date)
3. Maximum Occupancy: The maximum number of overnight guests for the property is limited to six (6) persons.
4. Cancellations –CANCELLATION POLICY
A. If renter provides written notice of a cancellation to owner more than 7 days prior to the check in date, renter will receive a 50 % refund of nights booked.
B. The burden is on the tenant to prove that he/she has sent notice of said cancellation and that owner has received the notice.
C. Cleaning fees are always refundable.
D. The Airbnb/(SENSITIVE CONTENTS HIDDEN) service fee is non refundable.
5. Additional charges and fees: All normal utilities are included, including wireless Internet. However, any cable use or Direct TV use (ie paid movies) are not included in basic services will be charged to tenant.
*The County of Santa Barbara requires a 12% bed tax on all bookings. This will be paid separately by the guest upon arrival. Airbnb does not collect taxes.
6. Tenant Responsibilities and other provisions(URL HIDDEN)A. Insure that no one smokes in the house. All guests must be aware that this is a high fire area. The only fire allowed is in the BBQ.
B. The tenant must supervise their guests on the premises. Noise must be kept a(URL HIDDEN) reasonable level in order not to cause a disturbance to neighbors.
C. All garbage and recycling must be placed in proper barrels under the front steps.
D. Notify the owner as soon as possible if anything, ie electrical problems, needs attention.
E. No pets allowed unless previously approved in writing.
F. The welcome notebook is helpful and should be read by all guests.
G. Cars may be parked in space nearest stairs, one behind the other, or in front of the house. The other covered space must be left open.
7. Conditions for return of cleaning deposit:
A. All trash and garbage is removed.
B. All dishes are cleaned or placed in dishwasher.
C. All your opened food in the refrigerator and cabinets must be discarded.
D. All tenants property is removed.
E. All doors are locked.
F. All house keys must be placed in agreed upon location. There is a fee of $10 for non- returned keys.
8. Hold Harmless and Indemnify Owner: Owner shall not be liable for and tenant agrees to hold owner harmless for any damages and/or injury to tenant and/or their guests, or their personal property due to tenants acts, actions or neglect.
9. Laws: If any dispute between owner and tenant were to arise the laws of the state of California shall govern. The location for the resolution of any dispute will be in Southern Santa Barbara County. The prevailing party shall be entitled to all his/her costs and legal fees from the other party.
10. Entire Agreement: This written agreement between owner and renter supersedes any other agreement that may have been entered into by the parties or any third party (i.e. Airbnb or VBRO). Owner informs tenant that he is attorney and he/she may want to have his or her own attorney review this agreement prior to signing it.
