Rental Agreement for ‘A Peace of Heaven’ Vacation Rental

By finalizing a reservation for this vacation rental, the guest agrees to the following terms and conditions. All persons in the rental party must also adhere to the following terms and conditions while in the vacation rental.
SAFETY INFORMATION - In the event of an emergency, contact 911. Afterwards, notify The Owner of the emergency as soon as possible. Smoke detectors and carbon monoxide detectors are located throughout the house, as well as fire extinguishers. If you smell gas or smoke, ensure all guests are safely out of The Cabin and at a safe distance from it. In the event of a fire, gas leak, or other similar event, emergency responders will be automatically dispatched to The Cabin by the security system.
GUEST LIST - As a part of our rental contract, we require a list of all guests who will be staying at The Cabin during each reservation for safety and liability purposes. Any person not included in The Guest list is not permitted to be at The Cabin during the hours of 11:00 PM to 7:00 AM unless The Owner is notified via text and approval is given (which is almost always is).
PRE-CHECKOUT INSTRUCTIONS - We ask that our guests please help us keep cleaning costs down by stripping all the used beds of their sheets and placing them beside their respective beds as well as by loading all dirty dishes into the dishwasher and starting a wash cycle prior to checking out. Also before departing, we request that guests remove all food items from the refrigerator and freezer and place all trash in the animal proof garbage receptacle located outside, next to the front door. Lastly, we request that guests turn off the AC and/or heating systems and close and lock all windows and doors before checking out. If you were provided with the access code to the emergency key lockbox, please return the two sets of cabin keys to the lockbox and scramble the numbers after closing. Other information regarding the checkout procedure can be found on the large black sign located in the laundry room/front door area, opposite the washer and dryer.
DAMAGE DEPOSIT - A $300 damage deposit is required to book a reservation. This deposit is held in escrow by Airbnb until seven days after the checkout date, at which point it is returned to the original payment method. Claims against the deposit will only initiated to cover the value of items that are broken and/or unaccounted for, as well as to cover any damage to the cabin and/or of the cabin's contents. Should the amount of damage exceed $300, the owner will request the additional amount from the guest within seven days from checking out. If unable to come to a resolution with the guest regarding the additional losses then the owner is able to initiate legal proceedings in the appropriate legal forum in order to reach a resolution regarding the additional costs.
CABIN INVENTORY - After each rental party checks out, a professional housekeeper will perform an inventory of all the cabin’s contents by checking the current contents against a master inventory list of the cabin’s contents present before the rental party’s check-in. By doing so we are able to ensure that no rental party is held responsible for damage caused by a previous rental party. Any unaccounted for or broken items will be valued according to their fair market price, accounting for depreciation and wear and tear.
OWNER-RESERVED AREAS - The owner lives in a completely separated apartment on the basement level of The Cabin. This floor is inaccessible and unavailable to guests. The basement level deck area is also strictly for The Owner's use, as well as any furniture and items located in this area. The closets in the master bedroom and the adjacent bedroom on the main floor are both used as storage space by The Owner and remain locked and inaccessible at all times. To compensate for closet space, we provide hanging racks, clothes hangers, and dressers that can be used by guests for clothing storage.
EARLY CHECKIN/LATE CHECKOUT - Guests may request early checking prior to their reservation beginning. If the reservation schedule permits, the owner may approve the request; he may also deny the request if the full five hour turnover period is necessary to prepare the cabin for the the next guests. A fee of $20 will be requested from the guest for each hour added to the reservation in the form of early checking in and late checking out (i.e. - if an Cearly check in request is approved for 12:00pm instead of the standard time of 4:00pm, an $80 fee will be requested from the guest prior to the change being made and that change being reflected in the reservation page). If the guest arrives for their reservation early or remains at the cabin after the reservation ended without the prior approval of the owner and the requisite fees having been paid, the owner reserves the right to make a claim against the guest's security deposit - $100 if under one hour or $300 if more than one hour and/or any other reservations are negatively affected.
GUEST PARKING - The pthearking area directly in front of The Cabin provides space for Their Owner's v ehicle as well as three to four guest vehicles. The owner's parking space, located to the far left side of the driveway near the down-slope, must remain available and accessible to The Owner at all times with no exceptions. To prevent the driveway from being overcrowded and blocked, overflow parking is provided for any additional vehicles and is located at the very beginning of the driveway in the gravel area. If any guests are inadvertently blocking access to The Owners parking space, we will contact them via phone and request that they move their vehicle immediately. Even if The Owner is not at The Cabin, the designated parking space for The Owner must remain open and accessible at all times.
PETS - Up to two pets are permitted in the home. A $25 fee with be charged per pet. Pet owners are responsible for cleaning up any/all of any mess caused by the pet(s). Pets must be crated while guests are away from cabin. A large collapsible crate is provided for guest use and is stored under the bed in the master bedroom. All pets must be up-to-date on rabies vaccinations and other vaccinations. All pets are to be treated for fleas and ticks prior to arrival. The cabin owner assumes no responsibility for illness or injury that pets may incur while on the premises. Guests that bring pets without notifying the owner and paying the requisite fees will have the fees doubled and claimed against their security deposit after checking out
CREDIT CARD CHARGEBACKS - The guest agrees to not initiate a credit card chargeback of any payments paid to The Owner for the reservation. Should a chargeback be initiated by The Guest, The Owner is able to and will promptly file suit in small claims court to regain any amount of money owed to The Owner for the reservation that was chargebacked. The suit will be filed in Watauga County and The Owner will forward all relevant paperwork to The Guest, The Guest's credit card or banking company, and Airbnb.
INDEMNIFICATION - The owner takes every opportunity to minimize the risk of injury and harm to guests on The Property. The guest and all persons in The Guest's rental Party agree not to hold The Owner responsible for any injuries or harm caused by a guest while on The Property during their reservation, with the exception of injuries or harm caused due to willful gross negligence by The Owner. Also, if a child or minor is injured on The Property The Owner will seek legal and/or judicial guidance to ensure that all of the child's rights are protected if the situation necessitates.
PERSONAL PROPERTY - All person's present during the reservation acknowledge that all guests' personal property, including vehicles, are not insured by Owner against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner recommends that Renter carry or obtains insurance to protect Renter and Renters guests and their personal property from any loss or damage.
MAXIMUM OCCUPANCY AND MINIMUM STAY - The maximum number of guests is limited to 12 persons. Each guest after nine will incur a $10 per night fee to cover the extra costs for housekeeping that are a result of large rental group's. This property requires a minimum two (2) night stay.
SMOKING - Smoking is not allowed within the rental unit. Smoking is allowed outside of the rental unit. All smoking remnants should be discarded properly in ash trays (provided) and NOT thrown into the yard or driveway. If there is evidence of smoking inside of the house the damage deposit will be forfeited.
ALCOHOL/DRUG USE - Alcohol is permitted on the property, but it is requested that excessive drinking be avoided as it can lead to damage of the property. All renters must abide by local and state laws which require alcohol to only be consumed by those over the age of 21. All renters must abide by local and state laws which prohibit the use and possession of illegal substances while on the property. Any evidence of illegal substances while on the property will result in the damage deposit being forfeited and law enforcement may be notified.
ADDITIONAL INFORMATION -
-No daily housekeeping service - While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the property.
-Falsified reservations - Any reservation obtained under false pretense will be subject to forfeiture of reservation deposit and rental money, and the party will not be permitted to check in.
-Written Exceptions - Any exceptions to the above mentioned policies must be approved in writing in advance of check in.
-Fireplace - Fireplace is a propane powered gas fireplace. Please do NOT throw any paper or other combustible materials in the fireplace. Fireplace is not for cooking. Do not move logs in the gas fireplace.
-Water and septic - This cabin is run on a well and a septic system. Please do NOT flush anything other than toilet paper into the septic system. If it is found that anything other than toilet paper has been flushed and the system is clogged, the renter will be charged for damages and plumbing fees and the reservation/damage deposit will not be refunded.
-Weather Policy/Road Conditions - During the winter and early spring, it is highly recommended to have a vehicle with four wheel drive, weather is unpredictable and roads can become dangerous to travel on. No refunds are given for road conditions. Owner is not responsible for any damages or injuries due to weather conditions.

My name is Michael, and I manage this rental property for my mother, Barbara. I live in Newport Beach, California - remotely taking care of all aspects of our family's vacation rental business, from communicating with our wonderful guests to managing our rental listings, social media pages, and our website. Barbara, who resides on the basement level of the cabin, works full time at a local veterinary clinic taking care of our town's cats and dogs. We like to think of our arrangement as a "family business", as I help my mother manage her listing here on Airbnb, communicate with our lovely guests, coordinate dates and times with our housekeepers and maintenance crews, and keep everything running smoothly. Our dear cousin, Jessica, is in charge of our Housekeeping crew, keeping the cabin in immaculate condition and meticulously preparing for each group of guests to arrive to a home that is both spotless and welcoming. She has been in the housekeeping business for just over fifteen years now and runs her own local house cleaning company as well.
As a family and a team, we do anything within our power to accommodate our guests and make sure their stay at our home is comfortable, relaxing, and one of a kind.
